Terms of Service & Privacy Policy
TowYardIQ (the "Service") is owned and operated by MKN Web Solutions, LLC ("we," "us," "our"). The Service is software that towing and vehicle-storage companies ("you," "Subscriber," "your company") use to manage dispatch, yard inventory, lien processing, billing, fleet, and related operations. By creating an account or using the Service you agree to these Terms of Service and the Privacy Policy below. If you do not agree, do not use the Service.
verified_user The short version
- TowYardIQ is software. We are not a towing company, lienholder, debt collector, auctioneer, or law firm, and we are not a party to any tow, impound, lien, sale, or payment you process.
- You are responsible for legal compliance. Lien-notice templates, statutory citations, deadline calculations, fee tables, and similar tools are conveniences — not legal advice. Towing, storage, lien, auction, and consumer-protection laws vary by state and locality. You must verify everything against your own jurisdiction and counsel.
- Your operational data is yours. You can export it. We do not sell it or share it with advertisers or data brokers.
- Driver location. The driver app shares a driver's device location with your company's dispatchers while a driver is on shift with the app open. Drivers should understand this before enabling it.
- We use a few service providers to make features work (maps, VIN lookup, payment processing, push notifications) — described in the Privacy Policy.
- The Service is provided "as is." We work hard to keep it running, but we don't guarantee it's error-free or always available.
Terms of Service
1. The Service & What We Are Not
TowYardIQ provides web and mobile software for tow-yard and impound operations, including dispatch and driver management, yard/vehicle inventory, lien tracking and notice generation, auction/run-list tools, invoicing and payment collection, fleet records, inspections, and reporting.
We are not a towing operator, motor club, vehicle storage facility, lienholder, repossession agent, debt collector, auctioneer, title agent, escrow service, insurer, or law firm. We do not tow, store, release, sell, or take title to any vehicle; we do not send legally binding notices on your behalf; and we do not approve, deny, or process any lien, sale, or refund. Those actions, and responsibility for them, are entirely yours.
2. Accounts & Eligibility
You must be at least 18 and authorized to act for your company to create an account. You are responsible for the accuracy of the information you enter, for all activity under your accounts, and for keeping login credentials secure. You are responsible for the roles and permissions you assign to your staff (owners, admins, dispatchers, clerks, accountants, drivers).
3. Acceptable Use
You agree not to: use the Service for any unlawful purpose; process tows, impounds, liens, or sales that you are not legally authorized to perform; misuse another person's data; attempt to breach, scrape, overload, or reverse-engineer the Service; or resell or white-label the Service without our written agreement. We may suspend access that threatens the security or integrity of the Service or other customers.
4. Your Responsibility for Legal Compliance
This is important. Tow, storage, abandoned-vehicle, lien, auction, mailing/notice, fee-cap, and consumer-protection requirements differ by state, county, and municipality, and they change over time. Features such as lien-stage timing, statutory citation fields, notice documents, fee and storage calculators, and tax handling are tools to assist your workflow, not a determination that any particular tow, charge, notice, or sale is lawful or compliant. You are solely responsible for confirming that your rates, notices, deadlines, recipients, mailing methods, and sale procedures meet every applicable legal requirement. Nothing in the Service is legal, tax, or financial advice.
5. Trial & Subscription
New companies begin on a 30-day unlimited trial with no payment required and no card on file. We will not begin charging without first making paid plans available to you and giving you notice. When paid subscriptions launch, continued use after the trial or any free period may require an active subscription; pricing, plan terms, and billing details will be presented before any charge. You may stop using the Service at any time.
6. Payments You Collect
If you enable online payments, card and bank transactions are processed by Stripe under Stripe's own terms. We do not store full card or bank numbers. Disputes, chargebacks, refunds, payout timing, and tax remittance for the payments you collect are between you, your customer, and Stripe.
7. Your Data
You retain ownership of the records you enter (calls, vehicles, customers, invoices, documents, photos, etc.). You grant us a limited license to host, process, and display that data solely to operate the Service for you. You can export your data, and you may request deletion of your account data subject to legal retention obligations.
8. Service Availability & Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any output (including notices, calculations, ETAs, decoded VIN data, geocoded addresses, or reports) is accurate or fit for a given legal or business purpose. Third-party data (e.g., NHTSA VIN decoding, map and traffic data) is provided by those sources and may be incomplete or wrong.
9. Limitation of Liability
To the maximum extent permitted by law, MKN Web Solutions, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, regulatory penalties, or wrongful-sale or improper-lien claims, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim (or $100 if you paid nothing).
10. Indemnification
You agree to indemnify and hold harmless MKN Web Solutions, LLC from claims, losses, and expenses (including reasonable legal fees) arising from your tows, impounds, liens, notices, sales, charges, refunds, or other operations, your use of the Service, or your violation of these Terms or applicable law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms, non-payment (once paid plans apply), or to protect the Service. We will provide a reasonable opportunity to export your data except where prohibited or where your conduct requires immediate action.
12. Changes
We may update these Terms or the Service. Material changes will be reflected by updating the effective date above and, where appropriate, by notice within the Service. Continued use after changes take effect constitutes acceptance.
Privacy Policy
What we collect
Account & company data: names, emails, phone numbers, roles, and the company and operational records you enter (calls, vehicles, owners/lienholders, invoices, payments, documents, and photos).
Driver location: when a driver uses the mobile driver app, the app shares their device's GPS location with their company's dispatchers — a location fix is recorded with each job status update, and, while a driver is on shift with the app open, the app relays location roughly every 30 seconds so dispatch can see truck positions. Location sharing is foreground-only (browsers cannot track location in the background) and requires the driver to grant permission. Drivers can stop sharing by going off shift, denying permission, or closing the app.
Device & usage data: we record basic technical data (browser/user-agent, IP address, timestamps, audit logs of significant actions) to operate, secure, and support the Service.
How we use it
We use this information to provide and operate the Service for you, route and track jobs, generate documents and invoices, send notifications, secure accounts, maintain audit trails, and provide support. We do not sell your personal or operational information, and we do not share it with advertisers or data brokers.
Service providers
We use a small set of providers to deliver features, sharing only what each needs:
- Stripe — payment processing for invoices you choose to collect online.
- NHTSA vPIC — VIN-to-vehicle decoding (a VIN you enter is sent to the U.S. government's free public VIN database).
- Map & traffic providers (e.g., OpenStreetMap/Esri tiles, TomTom traffic and routing) — to display maps, geocode addresses, show live traffic, and estimate arrival times.
- Browser push services (Apple, Google, Mozilla) — to deliver the notifications you opt into. A push subscription is tied to your device and the platform's notification key.
- Email delivery — to send transactional email (invitations, invoices, alerts).
These providers process data under their own terms and privacy policies.
Cookies
We use strictly necessary cookies to keep you signed in and to operate the Service. We do not use third-party advertising or cross-site tracking cookies.
Retention & security
We retain your data for as long as your account is active and as needed to provide the Service, and afterward as required for legal, tax, or audit purposes. We use reasonable technical and organizational measures to protect data, including encryption in transit. No system is perfectly secure, and we cannot guarantee absolute security.
Your choices
You can review and update account information in the app, export your records, control push notifications per device, and turn off driver location sharing. To request account data deletion or ask a privacy question, contact us below.
Children
The Service is intended for business use by adults and is not directed to children under 13.
